Brief overview of the efforts on drafting and implementation of the government programs in the area of achievement of gender equality in the Kyrgyz Republic

The Kyrgyz Republic has joined the Beijing Platform of Actions, ratified a number of international conventions, including the Convention on Liquidation of All Forms of Discrimination against Women (1997), and has signed the Declaration of Millenium. Thus, the government has assumed international political and legal obligations, including the requirement of regular reporting of the Kyrgyz Republic to the relevant UN bodies. The government has developed the normative legal framework and enacted such fundamental Laws of KR as “On the state guarantees of equal rights and equal opportunities for men and women” and the Law of KR “On social and legal protection against domestic violence”. In October, 2008 the Kyrgyz Republic submitted to the UN Committee the 3rd periodic report on implementation of the UN Convention on Liquidation of All Forms of Discrimination against Women. With the introduction of special measures into the Electoral Codeof KR (the requirement to have both women and men the lists of candidates from political parties) and a matrix of indicators CDS for 2007-2009, 24 women (26,6 %) were elected in the course of the parliamentary elections 2007.

In 1996 the State Commission on Family and Women’s Affairs was created under the Government KR with the purpose to strengthen the role of women in the state building, their adaptation to the new economic conditions, and ensuring their full and active involvement in political and public affairs, and provide effective support to the women’s initiatives. Later on, in 1998 the Commission was abolished and the National Board on Gender Policy under the President KR (further on the National Board) was established as a public body. It was later renamed and strengthened by creation of the working body, Secretariat, as a structural unit under the Presidential Administration of KR. In 2008 the power of the Secretariat of the National Board was transferred to the Department of Social Development in the Government Apparatus with the purpose to increase the responsibility of the government KR for the handling the gender issues.

The fact that a number of specialised National programs were adopted can serve as a confirmation of the country’s adherence to the solution of gender problems. At the first stage (1996-2000) during implementation of the National program "Ayalzat", based on the provisions of the Beijing platform of actions and focused on improvement of the women’s conditions, the institutional framework for gender policy was created. For the first time expenses related to the implementation of the program were included in the national budget, and responsibility for its implementation was assigned to the ministries, departments, local state administrations and self-government institutions, with the increased level of women’s representation in the parliament and the government.

The National Plan of action to achieve gender equality in KR for 2002-2006 focused on the development of gender equality policy was the second stage of the implementation of the gender agenda of the country. 

The second NPA to achieve gender equality in the Kyrgyz Republic for 2007-2010 was adopted which served as a fundamental document guiding the state gender policy, its goal, objectives and principles, areas and prioritiess within the framework of the Country Development Strategy (CDS) for 2007-2010

Process of development of new strategic documents in the area of gender policy in KR

As the previous NAP was completed, there was a need to draft the National Strategy to achieve gender equality in KR for 2012-2020 and the need was caused by the fact that despite some success in promoting the reforms aimed at gender equality within the framework of the previous NAPs, a number of problems remained unresolved and require new efforts on the part of all the stakeholders. The difficult political and economic situation in the country put forward new tasks for coordination of efforts of the government bodies, legislative and executive branches of power with all the civil society entities so that to exclude discrimination on the basis of gender and ensure protection of human rights as the highest human values.

Following the results of the meeting of the parliamentary Committee on Human Rights, Equal opportunities and Public associations held on April, 4th, 2011 and devoted to the analysis of the situation with implementation of the Law of the Kyrgyz Republic “On the state guarantees of equal rights and equal opportunities for men and women”, a decision was made to develop the National gender strategy on achievement of gender equality till 2020.

According to the order of government KR as of July, 6th, 2011 № 267-r an inter-agency Working group was established for drafting the National strategy on achievement of gender equality in the Kyrgyz Republic till 2020 and the National plan of action on achievement of gender equality in the Kyrgyz Republic for 2012-2014.

Development of the new National strategy on achievement of gender equality (NSGE) is one of the principle conditions of successful integration of the Kyrgyz Republic in the global community as the country has assumed a number of international obligations, having ratified the Universal Declaration of Human Rights, the Convention on women’s political rights, the Convention on liquidation of all forms of discrimination against women, ILO Conventions and the European Social Charter, the Beijing Declarationon and the Platform of actions, and the Resolution of the UN Security Council N 1325 and MDG.  

The section “Concrete measures for the implementation of the program” in the Mmidterm program of development of the Kyrgyz Republic for 2012-2014, approved by the order of the government of the Kyrgyz Republic as of September, 8th, 2011 № 540, has paragraph 126, which mentions the development of the National strategy of gender development till 2020 and the National plan of action on achievement of gender equality for 2012-2014;

126. The Ppolicy to achieve gender equality is aimed to promote gender initiatives through institutional capacity-building, and also through financing of gender policy measures and integration of gender equality policy into the national, sectoral and regional strategic documents. For that purpose the following is required:

-introduce changes and amendments into the Law of the Kyrgyz Republic “On social and legal protection against domestic vviolence”;

-prepare the National report on the progress in implementation of the Convention on liquidation of all forms of discrimination against women (СЕDAW) which will be presented in Jogorku Kenesh of the Kyrgyz Republic and the Government, and also to the civil sector;

-develop more advanced mechanisms of obligatory gender examination of all draft standard legal acts and development programs are developed;

-develop a draft National strategy of gender development till 2020;

-develop and approve the National plan of action on achievement of gender equality for 2012-2014 ;

- develop and approve the National plan of action on implementation of the resolutions of the UN Security Council 1325 (2000) and 1820 (2008) on guarantee of women’s participation at all levels of decision-making about the issues concerning prevention, regulation and settlement of conflicts

 

The budget of the Midterm Development Program sets the needs of the above part at the amount of 39 952,8 thousand Soms.

Within 2011 it is necessary to develop and adopt the National plan of action on achievement of gender equality for 2012-2014, including activities on implementation of the international obligations on gender equality. The above Plan is meant as an intermediate plan for the medium-term period of implementation of the National strategy on gender policy.

The functional analysis of the national institutional mechanism for the implementation of the gender policy in KR conducted during 2008-2009 by the request of the Government KR and supported by UN also confirmed the importance of introduction of a comprehensive gender approach in strategic documents of development, and also the need to reconsider the approaches and methodology of development of the national strategic documents on achievement of gender equality.

Meeting of the inter-agency working group:

On October, 17th there was a meeting of the Inter-agency working group established by the Order of the Government KR as of July, 6th, 2011, № 267-r specifically for drafting the National strategy on achievement of gender equality in the Kyrgyz Republic till 2020 and the National plan of action on achievement of gender equality in the Kyrgyz Republic for 2012-2014.

As a result of the meeting the Group approved the methodology, draft structure and calendar progress plan, including the dates of regional meetings. Also, a Coordination group was created in the Ministry of Labour, employment and migration KR from among the responsible officials of the Government Apparatus of KR, the key ministries and agencies, representatives of the international development agencies and the non-governmental sector.

Training for the regional facilitators from all regions:

On October, 24-25th 2011, the regional facilitators, along with the representatives of the oblast state administrations were trained on the issues of organization of the process of development of proposals to the draft National strategy and the National plan of action on achievement of gender equality at the regional level.

36 people participated in the training, including 8 Deputy Governors, representatives of the mayor’s offices from Osh and Bishkek (30 women and 6 men). It is necessary to make a positive comment that such representation of the regional coordinators is observed for the first time in the history of development of previous documents in the area of gender policy: facilitators from NGO and a representative from the state administration\the mayor’s office.  Such cooperation at the stage of the development of documents and joint organization of work gives hope not only for open proposals from the civil society, but also for cooperation after adoption of those documents in the process of their implementation.

The program of training for the regional facilitators included acquaintance of the participants with the background and context in which the National strategy and NAP 3 were drafted, with the proposed methodology of the development of documents, as well as with the calendar plan of actions. Practically all of the participants have positively evaluated the suggested plans and methodology of work.

Organizational issues related to preparation and delivering the seminars in regions have been coordinated separately. Participants have received a package of methodical and information materials, and also recommended distributing materials. 

During the training the dates of seminars to be held in the regions were approved and the experts were distributed per regions. 

Seminars held in the regions for the development of proposals to the new documents:

9 seminars were conducted on the development of proposals from the regions to the draft National strategy on achievement of gender equality till 2020  and the National plan of action till 2014.

Representatives of rayon and city administrations, territorial divisions of the profile ministries and agencies, as well as representatives of the non-governmental organisations participated in all the above regional seminars.

The seminars conducted in the above regions helped to develop the priority directions on achievement of gender equality and proposals for the national documents on achievement of gender equality.

Consultative meeting with NGO experts

On November, 2nd the Ministry of Labour, employment and migration KR hosted a consultative meeting of the members of working groups from the ministries and agencies involved in drafting of the National strategy on achievement of gender equality till 2020 and the National plan of action on achievement of gender equality for 2012 - 2014.

As the Deputy Minister, Ms. Nurijla Joldosheva, mentioned, those documents are different as instead of sector-based approach to the drafting a new approach was used, i.e., problem-oriented comprehensive gender approach, that will allow to avoid duplication of sector programs developed by different ministries and agencies. “Another distinctive feature is that the draft Strategy is based on analyses, requirements and needs of concrete groups of people at the regional level. Such an approach allows to involve the regional government institutions at the earliest stage and invite the civil sector to participate. By this, the regional authorities will receive support in the development of the gender policy at the local level”- informed N.Joldosheva.

Seminar of expert group

On December, 18th a seminar of Expert working group was conducted, The seminar organized the discussion of the first consolidated draft documents and presented the coordinated common vision, indicators of monitoring and evaluation of those documents, and also formulation of the medium-term goals, objectives and indicators of their achievement.

The seminar has developed an important clarification for the content-based division of indicators into product indicators (as reflected in NAP) and indicators of results and impact (reflected in the National strategy).

Next steps

At the moment all the activities at the level of regions have been completed and the proposed changes to the draft National strategy till 2020 and the Plan of action till 2014 are being summarized.

The expert group in coordination with the Ministry of Labour, employment and migration KR is also in the process of analysing and summarizing the proposals submitted by the ministries and agencies, as well as from the non-governmental organisations. At present indicators of monitoring and evaluation of policy measures in the draft documents are developed. Also, calculation of the required financial and other resources is made for their implementation. It is planned to finish the work by the end of February 2011. 

In future it would be necessary to present the drafts of the above strategic documents for public discussion and national consultations with the government bodies. It is necessary to involve representatives of regional authorities and local NGO in the process.
